WHO WE ARE

bhs-direct.com is a site operated by BHS Direct Limited terms (“We”, “Us”, “Our”, “BHSD”).  We are registered in England and Wales under company Number 10580735 and have our registered address at 130 Old Street, London EC1V 9BD, which is also our main trading address.

Our terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order, you agree to be bound by the terms and conditions set out herein.  We reserve the right, at our sole discretion, to change, modify, add, amend or remove any part of these Terms and Conditions from time to time and it is your responsibility to check these Terms and Conditions from time to time for changes.  We may modify or withdraw, temporarily or permanently, the Website (or any part of it) and we shall not be liable to you or any third party for any modification to or withdrawal of the Website.

Before you place an order, if you have any questions relating to these terms and conditions, please contact our Customer Service team.  All calls to Customer Services will be charged at the local rate (BT users only, other network charges may vary), and both inbound and outbound calls may be recorded for quality monitoring and training purposes.

Please note these Terms and Conditions do not affect your statutory right as a consumer.

All text, graphics, photographs, logos, trademarks, artwork, sounds, music, user interfaces, visual interfaces and computer code (the “Content”) belongs to bhs-direct.com (or is licensed to bhs-direct.com). This Content includes, but is not limited to, the design, structure, selection, coordination, expression, “look and feel” and arrangement of it. The Content is protected by copyright, trademark and other intellectual property rights and you are not permitted to copy, reproduce, republish, upload, post, publicly display, translate, transmit or distribute this Content in any way without ‘BHSD’ prior written permission.

You agree within these terms that any information you submit to the Website including Personal Information shall not be misleading and shall be true and accurate in all respects. If you submit to the Website any communication, idea or materials which may attract copyright or other intellectual property rights, you agree that this shall become ‘BHSD’ property and you agree that anything you submit shall not infringe any right of any third party, nor contain anything libellous or otherwise unlawful, abusive or obscene nor constitute an invasion of privacy. As such, you are and shall remain solely responsible for the content of any submissions you make on the Website and we reserve the right to remove any material you have placed on the Website or to deny you access to the Website at any time at our sole discretion.

PRODUCT TERMS & DESCRIPTIONS ON OUR WEBSITE

We will take all reasonable care to ensure that all product terms and descriptions are correct at the time when the relevant information was first entered onto the Website.  We have made every effort to display as accurately as possible the appearances, colours, texture or finishes of our products.  What you see will depend on your computer equipment, screen or monitor and we are therefore unable to guarantee that product images are an accurate representation of the actual merchandise.  Please refer to our Returns Policy terms if you are unhappy with your order.

TERMS OF OUR PRICING POLICY

Products shown on the Website are in British Pounds.  We try to ensure all products’ prices displayed in the product description are accurate but errors may sometimes occur.  If we discover an error in the price of a product you have ordered we will be unable to accept the order and shall contact you as soon as possible in order to give you the option of either reconfirming you order or cancelling it.

AGE RESTRICTIONS

We cannot sell Games or DVDs to anyone under the age certificate specified on the products.  By placing an Order for age restricted products, you warrant that you are at least (16) years old and the information you provide is both truthful and correct.  It is an offence to buy or attempt to buy these products or buy them for some else who is under age.

ORDER PROCESS TERMS

bhs-direct.com takes all reasonable care, in so far as is possible, to keep the details of your order and payment secure, but in the absence of negligence on our part we will not be liable for any loss you may suffer if a third party procures unauthorised access to any Personal Information you provide when accessing or placing an order on the Website.  For more information please refer to our Privacy & Cookie Policies terms.

 

Further details of the technical process between us and you can be found on our order page; however in brief these are as follows:

Orders are made on this Website by pressing the ‘Buy Now’ button at the end of the checkout process, you will be guided through the order process by a series of simple instructions.

You will need JavaScript enabled on your computer to buy products and check out. Please enable JavaScript in your browser, refresh your browser and then continue. Alternatively, please call 0845-862-1842 to order by phone.

We will send you an order confirmation email detailing the products you have ordered. This is not an order acceptance.

For items being delivered to you, when your product is dispatched, we will send you a dispatch confirmation email.

Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in change or cancel an order.

For most products sent directly from us, your credit/debit card will be charged when your order is dispatched.

If the product is being delivered direct to you from a supplier, for instance in the case of larger products such as electrical appliances or equipment, you will be charged at any point between confirmation of your order and dispatch.

Non-acceptance of an order may be a result of one of the following:

  • A Product you ordered is out of stock.
  • We are unable to obtain authorisation for your payment.
  • We have identified an error with a Product Description.
  • You are not eligible to order a product, due to age restrictions set out above.
  • There is a system or procurement failure.
  • You fail the customer validation checks

There are restrictions (legal or otherwise) or practices in relation to a product which prevent us from being able to sell or deliver to you.

CANCELLATION PROCEDURE BEFORE DISPATCH

If, for any reason, you wish to cancel your contract before your Order has been dispatched then you need to let us know immediately. In order to do so, you can either complete an online cancellation by logging into your bhs-direct.com Account.  Alternatively, you can let us know by contacting   our Customer Services team or by calling us on 0845-862-1842.   Once we have received notification from you of your wish to cancel your contract, subject to any monies having been taken from you, we will refund you the original purchase price and delivery charge for your Order within fourteen (14) days.  For more information, please see our Refunds Policy.

As it is our policy to try to process your Order immediately it may not always be possible to stop an Order from being dispatched.  If you decide to cancel your contract and your Order has already been dispatched, then you need to let us know within fourteen (14) days after the day on which you receive your Order. You can notify us by using any one of the options identified in this document, subsection ‘Cancellation Procedure Before Dispatch’.  Once we have received notification from you of your wish to cancel your contract, you then have a further fourteen (14) days to return the product or products you ordered with us, please refer to our Returns Refunds & Exchanges below.

All payments are calculated in British Pounds.
We accept payment for Orders by Maestro, MasterCard, Visa, Visa Debit, American Express and PayPal.

By placing your Order and making an offer to buy a Product, you authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time and this may include verification checks involving your debit or credit card number or credit reports in order to authenticate your identity; to validate your credit card; to obtain an initial credit card authorisation; to protect you and us from fraud; and to enable us to arrange delivery of your Order to your nominated delivery address.

RETURNS REFUNDS & EXCHANGE TERMS

STANDARD RETURNS

If you change your mind for any reason you are welcome to return your item within (30) days of delivery.

For a full refund or exchange Products must be returned in a saleable condition.  This means that they must be unused and in their original packaging with garment tags and any other security devices or seals still attached and intact.

We reserve the right to consider the condition of any Product that you wish to return and make any deductions appropriate if there are indications that the Product, its tags, security devices or seals have been used, removed, broken or tampered with. ‘BHSD’ are not responsible for any costs associated with the return of the item or items. We suggest you make appropriate arrangements for your return to be fully insured as non returned or damaged in transit goods, will not be refunded.

In the unlikely event of a fault, or if you wish to return the item for any other legal reason (such as it does not fit the description given to it on the packaging or website). You will be offered a refund, repair or replacement within (30) days of delivery. In the same circumstances, after (30) days, you will be offered the option of a repair or replacement (subject to product availability) in accordance with the manufacturer’s warranty.

We reserve the right to consider the condition of any Product that you wish to return and make any deductions appropriate if there are indications that the Product, its tags, security devices or seals have been used, removed, broken or tampered with.

NON-STANDARD RETURNS

‘BHSD’ standard returns policy does not apply to the following items and therefore are excluded from our standard return policy:

Products returned in a non-resalable condition, Gift cards, Personalised items, Made to measure, Fitted and home installed IOT products.

Furniture – Some items may be subject to an extended warranty and their own terms and conditions, which will be provided to you at the time of purchase.

Electrical Goods – Your electrical appliance has a manufacturer’s warranty. Full details of the warranty and how to register it are contained within the item’s packaging.

The manufacturer’s warranty and this Refund Policy do not affect your legal rights.

Some items may be subject to an extended warranty and their own terms and conditions, which will be provided to you at the time of purchase.

For all requests for refunds, exchanges or returns outside our standard policy you should in the first instance email us at customerservices@bhs-direct.com or by calling 0845-862-1842, who will advise you on your best course of action and, if appropriate, issue a (BRET) returns authorisation number.

Please note: These terms are absolute, we are not able to process any returns, refunds or exchanges without a vaild ‘BRET’ code.

MATERIAL AND ACTIVITY PROHIBITED BY LAW COMPLIANCE

Please choose carefully the material you post on the Website and which you provide to other Users. You must not misuse the Website. You will not: send or otherwise post unauthorised commercial communications to Users (such as spam); upload viruses, Trojans, Worms, Logic Bombs or other malicious code; corrupt data; cause annoyance to other Users; post material that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence; use the Website to do anything unlawful, misleading, malicious or discriminatory; facilitate or encourage any violation of these Terms and Conditions.

We also reserve the right to disclose your personal information if we are required by Law to do so and/or if you violate our Terms and Conditions by not complying with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

LIMITATION OF LIABILITY

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
any loss of goodwill or reputation; or
any special or indirect losses

suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
